DIGITANIMAL S.L. (hereinafter referred to as the MANUFACTURER) has developed a system (hardware and software, hereinafter referred to as the PRODUCT) that, once installed, allows the monitoring of animals through wireless sensors to achieve greater optimization of livestock farm resources or, where applicable, the tracking and research of wildlife. The PRODUCT is linked to SOFTWARE that enables remote control and geolocation of the PRODUCT.
1. OBJECTIVE OF THE CONTRACT
The purpose of this contract is the purchase of the PRODUCT and the acquisition of a license to use the SOFTWARE associated with each unit of the PRODUCT purchased.
The MANUFACTURER shall not, under any circumstances, be held responsible for the loss of animals or the devices they carry.
2. PROHIBITION OF RESALE
The resale of the PRODUCT purchased from the MANUFACTURER is expressly prohibited without the express prior written consent of the MANUFACTURER. Breach of this obligation will result in the automatic withdrawal of the SOFTWARE usage license and entitle the MANUFACTURER to receive compensation amounting to double the purchase price.
3. DURATION OF THE CONTRACT, WARRANTY AND RENEWALS
The SOFTWARE license associated with each unit of the PRODUCT shall have an annual duration, renewable in successive annual periods. This term begins upon the purchase of the PRODUCT, as does the two (2) year warranty. The customer has been informed of the characteristics, functionality, and instructions for commissioning the geolocation device and accompanying software.
The license will be automatically renewed unless either party expresses its intention to terminate the contract. Notification of the intention not to renew must be made to the other party at least one (1) month before the contract’s expiration and via reliable communication to the customer service team at: info@digitanimal.co.uk or by phone at +44 2045710853 (available Monday to Friday from 9 am to 7 pm, Spanish time).
Automatic renewal will entitle the MANUFACTURER to charge the renewal fee for the SOFTWARE license, as per the type of license in use, which is not specified in this contract. Each unit of the PRODUCT is associated with a unit of SOFTWARE.
The warranty covers manufacturing or assembly defects. The original warranty is void if the device has been mishandled, damaged, or broken accidentally.
Renewals occur 12 months from the device’s purchase date.
4. NOTIFICATIONS
Unless otherwise provided in this contract, any notification required to be made between the parties shall be sent via email to the individuals and addresses listed in this contract or by phone at +44 2045710853 (available Monday to Friday from 9 am to 7 pm, Spanish time).
5. RIGHT OF WITHDRAWAL OR REIMBURSEMENT
Purchasing the PRODUCT entitles the customer to withdraw from this contract within fourteen (14) calendar days from the date of purchase. To exercise the right of withdrawal or return, the customer must notify the customer service team at: info@digitanimal.co.uk or by phone at +34 914126657 (available Monday to Friday from 9 am to 7 pm, Spanish time).
Upon withdrawal and receipt of the PRODUCT, a refund will be issued, excluding shipping costs, using the same payment method employed in the initial transaction unless otherwise expressly agreed.
The PRODUCT must be returned or delivered directly to Avenida Castilla 1, Office 7B, 28830 San Fernando de Henares, Madrid, without undue delay and, in any case, no later than fourteen (14) calendar days from the contract’s initiation. The return will be considered fulfilled if the goods are dispatched before this deadline.
For the return to be accepted by the MANUFACTURER, the following conditions must be met:
- The PRODUCT must be returned in perfect condition and not used beyond verifying its proper functionality.
- The PRODUCT must not have suffered damage due to improper use.
- The PRODUCT must be in the same condition as delivered, including its original box and all original contents.
If the PRODUCT is not returned in its original packaging as indicated, with all its accessories, the MANUFACTURER reserves the right to deduct from the refund amount for any missing or damaged elements:

The MANUFACTURER reserves the right to reject returns if the conditions outlined above are not met. Orders benefiting from promotions or gift items must be returned entirely to receive a refund.
If a return is justifiably rejected and the customer notified, the customer will have three (3) months to collect their order from the MANUFACTURER’s facilities, bearing any associated collection costs. If not collected within three (3) months, the MANUFACTURER reserves the right to use the item.
This clause does not apply to virtual fencing devices.
6. DUTY OF CONFIDENTIALITY
The customer shall not make the PRODUCT and its associated SOFTWARE license available to third parties under any circumstances. The customer must take necessary measures to prevent the disclosure of information provided by the MANUFACTURER and will be liable for any damages arising from non-compliance by themselves or members of their organization.
7. COLLECTED DATA
Using the SOFTWARE linked to the PRODUCT allows for geolocation of the device, a functionality used to determine livestock locations. Accessing geolocation services on mobile devices requires user activation, which can be deactivated anytime.
The customer consents to the transfer of geolocation data to the MANUFACTURER, which will only use anonymized data for statistical purposes and service improvement. Details regarding data processing, usage, purposes, and user rights can be found in the Privacy Policy available on www.digitanimal.com
8. ACCEPTANCE OF THE CONTRACT
The payment of the present invoice entails the acceptance of the conditions of the contract
9. ARBITRATION
Any dispute, disagreement, question, or claim resulting from the execution, resolution, or interpretation of this contract or related matters shall be resolved definitively through arbitration under the Madrid Court of Arbitration.
The parties agree to abide by the arbitration ruling issued.
Before resorting to arbitration, the parties agree to attempt commercial mediation through mediators designated by the Madrid Bar Association’s Mediation Department (MediaIcam). If a list of mediators is offered, the parties will select, in this order, the mediator offering the price closest to the average or, in case of a tie, the one chosen by private draw.
